Mandamus proceedings commenced in the county court by a petition on the relation of Elmer Happel and wife against the appellants, Adolph Schmidt and two other supervisors, as the town board of the town of Polk, to command and compel their execution of an order and determination made by commissioners appointed under sec. 80.13, Stats., directing said supervisors to widen, under said statute, a private road pursuant to an application made in writing to said supervisors by Elmer Happel and wife. To the alternative writ of mandamus issued by the court, the appellants filed a motion to quash the writ on the grounds that no reason in law is stated for the issuance thereof in the petition, and that it does not show the relators are entitled thereto. The county court denied the motion to quash, and the appellants appealed from the court's order to that effect. FRITZ, Justice.
