This is an appeal from an order quashing, in part, a petition for a writ of certiorari taken to review the assessment on certain
real estate. The real estate involved is located in the town of Wilson, Sheboygan county, and consists of 10.23 acres. In
1968 the land was owned by Mr. and Mrs. William Hensel, and in 1969 it was owned by the appellant, Scotty Smith Construction
Company. The property was assessed by the board of review of the town of Wilson at $5,700 in both 1968 and 1969. The Hensels and appellant brought a petition for a writ of certiorari in the circuit court for Sheboygan county, seeking
a review of both the 1968 and 1969 assessment. The court determined that the 1968 assessment was discriminatory against the
Hensels and ordered the assessment set aside. The court further determined that since the land was sold in 1969 by the Hensels
to the appellant at the price of $13,500, the 1969 assessment, being less than the fair sale value of the property, could
not be disturbed. The Scotty Smith Construction Company appeals from that part of the court's order quashing the petition
for the writ of certiorari as to the 1969 assessment. No appeal or review is sought of the order and judgment setting aside
the 1968 assessment.
